What does bare ownership of a property mean?
Bare ownership is the ownership right over a property without the right to use or exploit it. In other words, the bare owner holds the property, but cannot live in it or rent it out while a usufructuary exists.
What is usufruct and what rights does it provide?
Usufruct allows you to live in, use or rent out the property even if you are no longer the full owner. It may be lifelong or for a specific period.
If I sell the bare ownership, can I continue living in my home?
Absolutely. This is the main advantage of this solution: you remain in your home as normal, with no change to your way of life.
How is the value of bare ownership calculated?
The basic factors that define the value of bare ownership are the age of the usufructuary, the market value of the property, the age and condition of the property and its marketability according to our criteria.
Can I rent out my home if I keep the usufruct?
Yes. The usufructuary has the full right to exploit the property, including renting it out.
What happens after my death? Who acquires the property?
Upon the death of the usufructuary, the usufruct ceases to exist and the bare owner becomes the full owner of the property.
Do I have to pay any taxes or expenses?
No. All notary fees, transfer tax and land registry expenses are covered by our company. You pay nothing.
How legally secure is this process?
It is a fully legal and established process carried out by notarial deed and registered with the Land Registry. It is provided for by the Civil Code.
Is it like a mortgage or a loan?
No. There is no mortgage, interest rate or installment. It is not a loan, but a definitive transfer of bare ownership with full preservation of your use of the property.
Is there an age limit for entering into this agreement?
There is no specific age limit.
The process may concern both older people who hold the usufruct and younger people who hold bare ownership. In practice, we evaluate each case separately and clearly inform you whether the solution is suitable and beneficial for you.
What types of property can I use in this way?
Homes, apartments, detached houses, holiday homes and even plots in residential areas, provided they are legally clear and without pending issues.
Can I choose between a lump sum and a monthly annuity?
Yes. In some cases you can choose either a lump-sum payment or a monthly payment. This is discussed on an individual basis.
What happens if there is a loan on the property?
The existence of a loan does not exclude the process, but the debt must first be settled. Part of the amount may be used for repayment.
Can I do this for a holiday home or second property?
Of course. It does not have to be your main residence. The solution is also ideal for second properties you no longer use.
Is there any chance someone can evict me from my home?
No. Your usufruct is legally protected and cannot be removed unless you decide so yourself. No one can expel you from the property.
Can I use bare ownership for more than one property?
Yes. You can make a separate agreement for each property, depending on its use, value and your needs.
